The Copyright and Performances (Application to Other Countries) Order 2005

The Copyright and Performances (Application to Other Countries) Order 2005 came into force on Thursday 1 May 2005.

It revokes The Copyright (Application to the Isle of Man) Order 1992, The Copyright (Application to Other Countries) Order 1999, The Performances (Reciprocal Protection) (Convention Countries and Isle of Man) Order 2003 and The Copyright (Application to Other Countries) (Amendment) Order 2003.

The Order renews and in some cases extends copyright and rights in performances to citizens of countries that are party to the Berne, Universal Copyright or Rome Conventions, TRIPS (Agreement on Trade-Related Aspects of Intellectual Property Rights or other countries that protect the copyright works or rights in performances of British nationals or residents.

The bulk of the Order consists of a table with 6 columns:
bullet

the extreme left hand column consists of a list of countries,

bullet

the second states whether there is protection for literary, dramatic, musical and artistic works, films and typographical arrangements in that country;

bullet

the third whether there is protection for sound recordings;

bullet

the fourth whether there is protection for wireless broadcasts;

bullet

the fifth whether there is protection for other broadcasts; and

bullet

the last whether there is protection for performances.
